The Veterans Administration has rules and regulations that are constantly changing. It is important to have an attorney that is up-to-date on the information. At the Elder Law Office of Scott E. Collins, PLLC, we have the knowledge and skills necessary to help veterans and their families receive the benefits they have earned.

There are several different programs and benefits that veterans and their families are entitled to receive. Sometimes it can be difficult to understand which program best fits your condition and needs. Two of the programs offered by the VA are Compensation and Pension (not to be confused with Military Retirement Benefits). There are certain eligibility guidelines for both programs.

Pension Eligibility

You must have at least 90 days of active service with one day during a war period.
If you entered active duty after September 7, 1980, you must have completed 24 months or have completed your period ordered for active service.
You must be 65 or older OR totally and permanently disabled OR in a nursing home OR receiving either Social Security Disability Insurance or Supplemental Security Income.
Certain Income and Asset conditions apply; however, these should be evaluated case by case because there are many exceptions. DO NOT take “you make too much” as an answer. We cannot emphasize this enough.

Compensation Eligibility

You must have service in the Uniformed Services on active duty, OR active duty for training, OR inactive duty training.
You were discharged under other than dishonorable conditions.
You are at least 10% disabled by an injury or disease that was incurred in or aggravated during your service.
