Elder Law Guidance

At Elder Law Guidance, our guardianship and conservatorship attorneys help Kentucky families across Madison County, Lexington, London, and surrounding communities legally protect loved ones who can no longer make safe decisions for themselves.

With more than 10 years of focused elder law practice and recognition as Super Lawyers Rising Stars, our team guides you through the court process with step-by-step direction. One client shared that we “calmed all fears that I had during a traumatic time with my elder mother,” a reflection of the steady support families in crisis deserve.

In Kentucky, when an adult loses the ability to manage health care decisions or finances due to dementia, cognitive decline, or a sudden medical event, a court-supervised guardianship or conservatorship may be the only legal pathway available to protect them, especially when no valid power of attorney was put in place ahead of time.

Our team walks families through every phase of the process, from determining whether guardianship is truly necessary, to filing with the District Court, and meeting ongoing reporting obligations. If you need emergency guardianship or want to modify an existing order, we are here to guide you with clarity.

The Difference Between Guardianship vs. Conservatorship in Kentucky

In Kentucky, guardianship and conservatorship are two separate legal roles a court can assign when an adult can no longer make safe decisions on their own.

Guardianship covers decisions about health, safety, housing, and daily care. A guardian may approve medical treatment, choose a living arrangement, or coordinate caregivers.

Conservatorship covers management of finances, accounts, and property. A conservator handles bank accounts, files taxes, and protects assets from misuse.

Kentucky also allows limited guardianship or conservatorship when a person can still handle some decisions on their own. In that case, the court only transfers the specific powers the person cannot manage, which helps preserve as much independence as possible.

Kentucky courts must find clear and convincing evidence that a person cannot make informed personal or financial decisions before appointing a guardian or conservator. That standard requires thorough medical documentation and skilled legal advocacy.

Understanding which role fits your family’s situation is the first step toward protecting a loved one with dignity and care.

When Is Guardianship or Conservatorship Necessary in Kentucky?

Common triggers for guardianship or conservatorship in Kentucky include:

  • Advancing dementia or Alzheimer’s disease
  • Sudden hospitalization or severe stroke
  • Traumatic brain injury after an accident
  • Cognitive decline affecting safety or finances
  • Developmental or intellectual disabilities reaching adulthood

Guardianship or conservatorship may be necessary when no valid POA exists, the document is too limited, the person already lacks capacity, or family members disagree about care.

In those cases, Kentucky district court must appoint a decision-maker through the formal process. Acting early, while your loved one can still participate, often means fewer court hearings and less family conflict.

About Elder Law Guidance

Elder Law Guidance was founded in October 2015 by Scott E. Collins, a Richmond attorney whose practice is rooted in military discipline, ministry service, and a commitment to Kentucky families. For more than a decade, the firm has helped families protect what they have built and plan for what comes next.

Our mission is simple. We help families avoid starting over financially after a long-term care crisis, and we do it through plain-language education, not pressure. If the conversation is about Medicaid, VA benefits, trusts, or guardianship, we want you to understand the why behind every decision.

We also believe good planning is a team effort. Our team works closely with financial advisors, CPAs, and family members so every part of your plan fits together. With a 4.9-star rating and recognition on the Super Lawyers Rising Stars, our work continues to be guided by the principle that we treat every family with dignity and respect.

Understanding Guardianship vs. Power of Attorney and Which Your Family Needs

Many Kentucky families assume guardianship is the only option when a loved one needs help making decisions, but a power of attorney may be a simpler and less costly alternative if it is signed while the person still has capacity.

The main options include:

  • Power of Attorney: A voluntary document that lets a chosen agent handle financial or legal matters without court involvement.
  • Healthcare Surrogate: A Kentucky document that authorizes someone to make medical decisions without going through guardianship court.
  • Guardianship: A court-supervised process used when capacity has already been lost and a judge must appoint a decision-maker.

The key difference is timing. A valid POA may help avoid full guardianship, but it must be signed before capacity is lost. Planning early can reduce court involvement, lower costs, and give families clearer authority when decisions need to be made.

Our Guardianship and Conservatorship Process For Kentucky Families

1. Free Initial Consultation

We start by listening. You share what is happening with your loved one, and we help you understand your options in plain language.

2. Evaluate Whether Guardianship Is Truly Needed

Sometimes a power of attorney or less restrictive alternative is a better fit. We help you weigh what protects your family member without removing more rights than necessary.

3. Gather Medical Evaluations and Documentation

Kentucky requires an interdisciplinary report from qualified professionals. We guide you on what to collect and coordinate the paperwork.

4. Prepare and File the Petition

We draft and file the petition in Madison County District Court (or the appropriate county court) and make sure every detail meets Kentucky statutory requirements.

5. Court Hearing and Appointment

A jury determines partial or full disability under KRS Chapter 387. We prepare you for what to expect so you can walk in with confidence.

6. Ongoing Compliance and Annual Reporting

After appointment, guardians must file reports with the court each year. We stay available to help you meet deadlines and handle changes as life evolves.
