Understanding VA Pension Eligibility

VA Pension eligibility comes down to four pieces: service history, income, net worth, and care needs. 

Service and Discharge

The veteran must have served at least 90 days of active duty with at least one day during a recognized wartime period (such as WWII, Korea, Vietnam, or the Gulf War, which remains open). Discharge must be other than dishonorable.

Income and Medical Expenses

The VA looks at countable income against a set yearly limit called the Maximum Annual Pension Rate. Unreimbursed medical expenses, including in-home care, assisted living, and nursing home costs, can reduce countable income and often make the difference between approval and denial.

Net Worth and the 3-Year Look-Back

The VA uses a single net worth limit that combines assets and annual income, adjusted each year. Asset transfers made within 36 months of applying can trigger a penalty period, so timing matters.

Care Needs

Higher benefit tiers, Housebound and Aid and Attendance, require documented help with daily activities or confinement to the home.

Aid and Attendance vs. Housebound Benefits

Both benefits add money on top of the basic VA pension, but they serve different needs. 

Aid and Attendance

Generally for veterans or surviving spouses who need help with daily activities like bathing, dressing, eating, or managing medication. It also applies to those who are bedridden, living in a nursing home due to disability, or have significant vision loss.

Housebound

Generally for those who are substantially confined to their home because of a permanent disability. The focus is on confinement, not hands-on care.

Key Differences at a Glance

  • Aid and Attendance centers on personal care needs.
  • Housebound centers on being confined to the home.
  • The VA’s 2026 rate table shows a veteran with no dependents may have a MAPR of $21,313 with Housebound or $29,093 with Aid and Attendance, and the two add-ons cannot be paid at the same time.
  • Each application requires medical evidence supporting the specific need.

A Kentucky’s Long-Term Care Insurance Guide notes that a single applicant must reduce countable assets to $2,000 to qualify for Medicaid long-term care, and Kentucky Medicaid can review asset transfers made during the five years before application. 

A gift or trust transfer that helps with VA pension eligibility could trigger a Medicaid penalty period down the road.

Documents to Gather for a VA Pension Application

Having the right paperwork ready can help speed up your VA Pension claim and reduce back-and-forth with the VA. Use the checklists below to gather the documents that apply to your situation before your consultation.

For Veterans

  • DD-214 or other military discharge papers showing dates and character of service
  • Marriage certificate and any divorce decrees from prior marriages
  • Social Security card and government-issued ID
  • Income records, such as Social Security award letters, pension statements, 1099s, or recent tax returns
  • Asset records, including bank statements, brokerage accounts, retirement accounts, and deeds
  • Life insurance policies and annuity contracts
  • Unreimbursed medical expense records and receipts
  • Care provider statements, assisted living invoices, or home health agreements
  • Physician statement describing care needs, such as VA Form 21-2680 for Aid and Attendance
  • Any prior VA correspondence, claim numbers, or denial letters

For Surviving Spouses

  • Veteran’s DD-214 or other discharge documents
  • Marriage certificate showing marriage to the veteran
  • Veteran’s death certificate
  • Proof that the marriage continued until the veteran’s passing

Frequently Asked Question About VA Pension 

My dad served in Vietnam but never saw combat. Does he still qualify for VA Pension with Aid and Attendance?

Yes, combat service is not required for VA Pension. Your father needs at least 90 days of active duty with one day during a wartime period, and Vietnam-era service qualifies. He will also need to meet age or disability requirements, income and net worth limits, and show a need for care. Service members often misunderstand this benefit and assume that they do not qualify without first seeking screening from legal counsel. 

How does the VA’s three-year look-back rule actually work when transferring assets?

Since October 2018, the VA reviews asset transfers made within three years of applying for Pension benefits. If assets were given away or moved into certain trusts during that window to get under the net worth limit, the VA can impose a penalty period of up to five years. However, there are several ways to work around any penalty period.

Can my mom receive VA Pension and Medicaid at the same time for her nursing home stay?

She can technically receive both, but the numbers rarely work in her favor without planning. Once Medicaid begins paying for nursing home care, VA Pension typically reduces to $90 per month for the veteran or surviving spouse in a Medicaid-covered facility. 

What counts as “unreimbursed medical expenses” that can lower the income calculation?

The VA allows you to deduct ongoing, out-of-pocket medical costs from your countable income, which often makes the difference between qualifying and being denied. This includes Medicare premiums, supplemental insurance, prescription costs, in-home caregiver pay, assisted living fees tied to care, and nursing home costs. 

My grandfather has dementia and cannot sign his own application. Who can apply on his behalf?

A properly appointed fiduciary, agent under a durable power of attorney, or VA-accredited representative can assist with the application. If no power of attorney exists and he lacks capacity to sign one now, the family may need to pursue guardianship through  the Laurel County the Madison County District Court or the appropriate Kentucky court for your county. 

Is it true that only attorneys accredited by the VA can help with Pension claims?

Yes, federal law requires that anyone assisting with VA benefit claims for compensation be accredited by the VA. This protects veterans from unqualified advisors and financial product salespeople who push annuities or trusts that may actually disqualify the veteran. Always ask if the person helping is VA-accredited before signing anything.

How long does it really take to get approved for Aid and Attendance after applying?

Processing times vary, but most applications take four to eight months, and some stretch beyond a year if documentation is incomplete. However, some applications process within weeks. Regardless, the VA pays retroactive benefits back to the month after the application was filed, so submitting a complete application quickly is more important than waiting until everything feels perfect. 

Will applying for VA Pension affect my parent’s Social Security or other retirement income?

No, VA Pension does not reduce Social Security, pensions, or retirement account distributions. However, those income sources do count toward the VA’s income calculation, which is why unreimbursed medical expenses are so important to document.
