At Elder Law Guidance, our attorneys help Corbin families protect a loved one’s care and the homeplace after a stroke or dementia diagnosis.
Since 2015, we have earned a 4.9-star rating across 115+ Google reviews. Kentucky nursing home care costs more than $9,000 per month, and a paid-off house or family land raises real questions about how to qualify for Medicaid without losing everything.
Elder law covers powers of attorney, guardianship, and Medicaid planning for nursing home care. A power of attorney is a signed document naming someone to handle a loved one’s affairs. Guardianship is the court process used when a loved one can no longer sign.
Medicaid planning addresses the five-year look-back on gifts and transfers, and estate recovery, the state’s claim on an estate after Medicaid pays for care.
Many families first reach out after a hospital stay, when a discharge planner wants decisions within days. Options often still exist. Guardianship cases are heard in district court in Williamsburg, Barbourville, and London, depending on the county.
Why Choose Elder Law Guidance
Education-First Planning
We explain each step and why it matters. A power of attorney lets someone you trust handle a loved one’s affairs, and guardianship is the court route when no one signed one in time.
Calm Support During a Crisis
Many families reach out after a stroke, fall, or hospital discharge, and options often still exist. Conversations stay private.
Protecting the Homeplace and Family Land
Planning aims to keep families from starting over financially, though results depend on your family’s facts. We also look at tax implications and planning for the spouse who remains at home.
Service-Rooted, Team-Based Care
Our team is built on military and ministry values and keeps you informed at every stage. Veteran families also get guidance on pension benefits that help with care costs.
Learn First Through Webinars
Our webinars cover trusts, Medicaid, and long-term care before you decide anything. Family members out of state can join from anywhere.

What Is Kentucky’s Medicaid Look-Back Period, And What Happens If I Gave Away Property?
Kentucky uses the federal five-year look-back. When a loved one applies for Medicaid to pay for nursing home care, the state reviews money or property given away in the 60 months before the application. Transfers for less than fair market value in that window can trigger a penalty period of ineligibility for long-term care coverage.
A penalty period is a stretch of time when Medicaid will not pay the nursing home. A larger gift means a longer wait. Deeding the homeplace or family land to a child for a dollar counts as a transfer.
Some transfers are exempt, such as gifts to a spouse or a home passed to a child who lived there and provided care for at least two years. Many families start planning after a nursing home admission, and options often still exist.

Can My Parent Get Care At Home Through Kentucky Medicaid Instead Of A Nursing Home?
Often, yes. Kentucky Medicaid home and community-based waiver programs can pay for care at home when a loved one medically needs a nursing home level of care and meets Medicaid’s income and asset limits.
Waivers can cover in-home aides, adult day care, and respite for family caregivers, though some have limited openings or waiting lists. Ask the discharge planner about them before anyone signs nursing home admission papers.
Families often miss these planning gaps:
- The look-back period: Medicaid reviews every gift or transfer from the past five years, including deeding family land to a child.
- Estate recovery: after a loved one passes, the state may seek repayment from what they leave behind, which can include the homeplace.
- Power of attorney: the document may lack Medicaid planning authority or may never have been signed, and a court may then need to name a guardian.
- VA Aid and Attendance: benefits for veterans and surviving spouses often go unclaimed.
Early planning can protect savings, the homeplace, and a spouse who stays at home, and it should account for potential tax implications as well.
Can Veterans Or Surviving Spouses In Kentucky Get Help Paying For Long-Term Care?
Yes. The VA’s needs-based pension, with added Aid and Attendance or Housebound benefits, may help eligible wartime veterans and surviving spouses pay for long-term care. It is a monthly payment, separate from other VA benefits.
Eligibility generally has three parts:
- Service: usually 90 days of active duty, with at least one day during a recognized wartime period.
- Finances: income and net worth limits, plus a three-year look-back on gifts or transfers made in the past three years, which can result in a penalty.
- Medical need: needing help with daily tasks like bathing or dressing, or being mostly confined to home.
Kentucky Medicaid uses its own five-year look-back, so a move that helps with one program can affect the other. Claims often stall over missing paperwork, so gather the veteran’s DD-214 discharge papers, a marriage certificate for a surviving spouse, and recent medical records first.

Elder Law Questions in Corbin
Common Elder Law Questions
If Mom Can No Longer Sign Anything, Is Guardianship In Kentucky The Only Option Left?
Not always for medical choices, because Kentucky law lets close family make many health decisions without a signed form. Guardianship, where a judge names someone to decide for an adult who cannot, runs through district court in Williamsburg, Barbourville, or London. Read how a court-appointed guardian is chosen first.
How Far Back Does Kentucky Medicaid Look At Gifts Or Deeding Family Land Before Paying For Nursing Home Care?
Five years. The look-back covers the 60 months before applying, and a transfer below value in that window can mean months when Medicaid will not pay.
Does A Paid-Off House Count Against My Dad When He Applies For Nursing Home Medicaid?
Usually not while he intends to return home or a spouse still lives there, up to Kentucky’s home equity limit. Savings and extra land are judged differently.
Will Kentucky Medicaid Take The Homeplace After My Parent Passes Away?

Can A Veteran Parent Get VA Help With Care Costs On Top Of Social Security?
Many can. Aid and Attendance is an added monthly VA pension payment for wartime veterans or surviving spouses who need help bathing or dressing. The VA applies a three-year look-back, while Medicaid applies five years.
